Cuban criteria concerning to access and benefit sharing on the use of genetic resources

Abstract
The protection of biological diversity is an obligate theme at present issue, taking into account that the human evolution depends on the possibilities to use of natural resources to solve the human problems of foods, pollution and others. Cuba is an important part of the global forum where the discussions are addressed to the common terms to obtain an agreement of the International Regime of Access (IRA) to those resources, specially because of the Cuban natural flora and fauna characteristics, and the high percentage of endemism, which put the country as one of the most important among the Planet Isles. Some actual laws in the country are related to the access of biological resources, specially the Chapter 11 from the Resolution Number 111/96 from the Ministry of Science, Technology and Environment (CITMA) standing from November/1996). The National Commission of Genetic Resources is the central axe in the coordination with the Governmental Institutions about the access issue and the most important criteria. It is defending in the international context at the moment, and they are addressed to the inclusion of all genetic resources in the IRA, their derivates, and the associate practices from their use, the recognition of the origin of the resource that was accessed, as well as the scientific and commercial use as an extension of the IRA, and the incorporation of knowledge, innovation and traditional practices on the use of biological diversity under the Convention of Biological Diversity (CBD) regulations, with the objective of protecting the natural resources from indigenous and local communities and the associated knowledge.
